1. Acceptance of Terms

Welcome to Alarm Buddy! These Terms of Service ("Terms") govern your use of the Alarm Buddy mobile application ("App," "Service," "we," "our," or "us") developed by Hemant.

By downloading, installing, or using Alarm Buddy, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Description of Service

Alarm Buddy is an iOS alarm clock application that provides:

Customizable alarm settings and scheduling
Interactive wake-up games with buddy characters
Various difficulty levels and sound options
Haptic feedback and snooze functionality
Repeat alarm scheduling
Local notification delivery

The App is designed to help users wake up on time through engaging alarm experiences.

3. Age Requirement

You must be at least 13 years old to use Alarm Buddy. By using this App, you represent and warrant that you are at least 13 years of age.

If you are under 18 years old, you must have permission from a parent or legal guardian to use this App.

4. User Responsibilities

4.1 Device Requirements

You are responsible for:

Ensuring your device meets the minimum requirements (iOS 15.0 or later)
Maintaining your device in good working condition
Keeping your device charged and functional
Maintaining appropriate device settings for alarms to function

4.2 Proper Use

You agree to:

Use the App for its intended purpose (alarm functionality)
Not attempt to reverse engineer, decompile, or disassemble the App
Not use the App for any illegal or unauthorized purpose
Not interfere with or disrupt the App's functionality
Comply with all applicable laws and regulations

4.3 Device Settings

You are responsible for:

Enabling necessary permissions (notifications)
Configuring your device volume appropriately
Managing Do Not Disturb and Focus mode settings
Ensuring your device is not on silent mode when alarms should sound
Maintaining sufficient battery charge

5. Disclaimer of Warranties and Limitation of Liability

5.1 "AS IS" Disclaimer

ALARM BUDDY IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Warranties of merchantability
Fitness for a particular purpose
Non-infringement
Accuracy, reliability, or completeness

5.2 No Guarantee of Alarm Functionality

IMPORTANT: WE DO NOT GUARANTEE THAT ALARMS WILL SOUND AT THE SPECIFIED TIME.

Alarm functionality may be affected by:

Device settings (Do Not Disturb, Focus modes, silent mode)
Low battery or device power-off
iOS updates or system changes
Device malfunctions or hardware issues
Notification permission settings
App force-quit by user
Storage limitations
Network or cellular issues (for analytics only; alarms work offline)
Other technical issues beyond our control

5.3 User Backup Responsibility

YOU ARE SOLELY RESPONSIBLE FOR ENSURING YOU WAKE UP ON TIME.

We strongly recommend:

Maintaining a backup alarm method (traditional alarm clock, another device)
Testing alarm functionality before critical wake times
Not relying solely on Alarm Buddy for important appointments
Using multiple alarms for critical situations

5.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEMANT AND ALARM BUDDY SHALL NOT BE LIABLE FOR:

Missed alarms or failure to wake up
Missed appointments, meetings, flights, or other time-sensitive events
Loss of employment or business opportunities
Any direct, indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, or use
Cost of substitute goods or services
Any damages arising from use or inability to use the App

This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

5.5 Maximum Liability

In no event shall our total liability to you for all damages exceed the amount you paid for the App in the past twelve (12) months, or $10.00 USD, whichever is greater.

6. Indemnification

You agree to indemnify, defend, and hold harmless Hemant, Alarm Buddy, and its affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

Your use or misuse of the App
Your violation of these Terms
Your violation of any rights of another person or entity
Missed alarms or failure to wake up
Any consequences resulting from alarm malfunction

7. Intellectual Property Rights

7.1 Ownership

Alarm Buddy, including all content, features, functionality, source code, design elements, graphics, buddy characters, sounds, and trademarks, is owned by Hemant and is protected by international copyright, trademark, and other intellectual property laws.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to:

Download and install the App on your personal iOS device
Use the App for your personal, non-commercial purposes

You may NOT:

Copy, modify, or create derivative works
Distribute, sell, rent, lease, or sublicense the App
Remove or alter any copyright, trademark, or proprietary notices
Use the App for commercial purposes without permission

8. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

By using Alarm Buddy, you consent to our data practices as described in the Privacy Policy.

9. Third-Party Services

Alarm Buddy uses third-party services:

Firebase Analytics & Crashlytics (Google)

Used for app analytics and crash reporting
Subject to Google's Terms of Service and Privacy Policy

We are not responsible for the practices or content of third-party services.

10. Updates and Changes

10.1 App Updates

We may release updates to improve functionality, fix bugs, or add features. Updates may be:

Automatic (if device settings allow)
Available through the App Store
Necessary for continued use of the App

10.2 Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting the updated Terms with a new "Last Updated" date.

Continued use of the App after changes constitutes acceptance of the modified Terms.

11. Termination

11.1 Your Rights

You may terminate your use of Alarm Buddy at any time by:

Deleting the App from your device
Discontinuing use of the Service

11.2 Our Rights

We reserve the right to:

Suspend or terminate access to the App at any time
Discontinue the App or any features
Refuse service to anyone for any reason

11.3 Effect of Termination

Upon termination:

Your license to use the App ends immediately
All data stored locally on your device will be deleted if you uninstall
Provisions that should survive termination (disclaimers, limitations of liability, indemnification) will remain in effect

12. Governing Law and Jurisdiction

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

12.2 Dispute Resolution

Any disputes arising from these Terms or use of the App shall be resolved through:

Good faith negotiation between parties
If unresolved, binding arbitration in India
Each party bears their own costs unless otherwise determined

12.3 Jurisdiction

You agree to submit to the personal jurisdiction of courts located in India for any actions not subject to arbitration.

13. Apple App Store Terms

13.1 Acknowledgment

You acknowledge that:

These Terms are between you and Hemant, not Apple
Apple is not responsible for the App or its content
Apple has no obligation to provide maintenance or support
Apple is not liable for any claims related to the App

13.2 Third-Party Beneficiary

Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you.

13.3 App Store Rules

Your use must comply with Apple's App Store Terms of Service and Usage Rules.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hemant regarding use of Alarm Buddy.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

14.4 Assignment

You may not assign or transfer these Terms or your rights under them without our written consent. We may assign these Terms without restriction.

14.5 No Implied Rights

Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship.

14.6 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control.

15. Emergency Disclaimer

ALARM BUDDY IS NOT A MEDICAL DEVICE OR EMERGENCY ALERTING SYSTEM.

Do not rely on Alarm Buddy for:

Medical emergencies or health-critical timing
Emergency alerts or notifications
Life-safety applications
Mission-critical operations

For medical or emergency situations, use appropriate medical devices or emergency services.
